Free Influencer Agreement Template (PDF)

An influencer agreement is a contract between a brand and a content creator for a paid promotion. It sets the deliverables and posting dates, the brand's approval rights, the FTC disclosure, the fee, how the brand may reuse the content, any exclusivity, and what performance data the creator reports.

When to use it

Use it for any paid or gifted collaboration with a creator on Instagram, TikTok, YouTube, or another platform, whether you're the brand or the creator. Most influencer disputes are about usage rights (can the brand run the video as an ad?), late or missing posts, and payment timing. This agreement answers each of those in writing.

Frequently asked questions

Does an influencer have to disclose a paid partnership?

Yes. FTC rules require a clear disclosure of any material connection with a brand, including payment or free products. Use "#ad" or the platform's paid-partnership label where viewers will see it, not buried among hashtags.

Who owns influencer content?

Unless the contract says otherwise, the creator owns what they create. The brand gets the right to use it through a license, and this template lets you define its scope and length. Broader rights, like paid ads or a buyout, usually cost more.

What is whitelisting?

Whitelisting, or Spark Ads on TikTok, is when a brand runs paid ads through the creator's account or with the creator's post. It needs the creator's permission and is usually priced separately, which is why this template lists it as an option.

Can an influencer contract be signed online?

Yes. Under the U.S. ESIGN Act and state UETA laws, an e-signed influencer agreement is as valid as a paper one, and creators can sign on their phone without an account.
